Dorrell et al v. Constellation Energy Corporation et al., Case No. 1:25-cv-02251 (United States District Court for the District of Maryland)

This class action alleges that 26 nuclear power companies conspired to exchange confidential information about and depress the compensation of their employees in violation of the federal antitrust laws.

The defendants named in the lawsuit include 26 nuclear power companies—including Constellation Energy, Entergy, Dominion Energy, Southern Company, NextEra Energy—that operate all the nuclear power plants in the United States, including.  Two consulting companies that facilitated the exchange of compensation data—Accelerant Technologies and Human Resources Consultants—are also named as defendants in the lawsuit.

The lawsuit alleges that since 2003, the defendants conspired to fix and depress compensation paid to nuclear power generation employees through a series of overt acts, including: the exchange of confidential collective bargaining agreements; inter-defendant communications about current and future compensation rates; and private, in-person meetings where roundtable discussions were held to set compensation rates.

The lawsuit alleges that the intended and actual effect of defendants’ conspiracy to fix compensation has been to reduce and suppress the salaries, wages, and benefits paid to workers in nuclear power generation to levels materially lower than they would have been in a competitive market.

Plaintiffs seek to represent all persons employed in nuclear power generation by the 26 nuclear power companies and their subsidiaries and related entities in the United States from May 1, 2003 to the present day. The lawsuit seeks to prevent the defendants from continuing their conspiracy and to recover financial damages for the class of workers.
