Plowden v. Similasan Corp., Civil Action No. 1:23-cv-02511 (U.S. District Court for the District of Colorado).
This consumer class action alleges that Similasan Corp. is illegally marketing homeopathic products that claim to relieve various “minor eye symptoms” in contravention of the Federal Food, Drug, and Cosmetic Act and parallel state law. The complaint alleges that defendant is marketing a drug without having secured the appropriate approvals from the Federal Food and Drug Administration.
The complaint alleges that defendants have been cited by the FDA both for selling a drug without approval and for significant violations of Current Good Manufacturing Practices. The complaint further alleges that defendant’s eye drop products are considered adulterated by the FDA and should not be sold.
