Orshan v. Apple Inc., Civil Action No. 5:14-cv-05659 (U.S. District Court for the Northern District of California).
This consumer class action concerns allegations that certain Apple devices, including iPads and iPhones with 16 GB of memory, possess materially less storage than promised—as much as 21.3% less. Plaintiffs allege that Apple engaged in false and misleading advertising when it failed to account for the storage space occupied by the iOS operating system and built-in applications when the company advertised the available space on the devices. The case also challenges Apple’s aggressive marketing of paid iCloud storage space after providing materially less storage than was promised.
