This wage theft class and collective action was brought on behalf of a group of former employees of Barton Malow Company and MBA Construction, Inc., alleging that their employers failed to pay workers overtime premiums. Specifically, the complaint alleges that while employed by Defendants at different project sites across Virginia (including construction at Virginia Commonwealth University), Plaintiffs regularly worked in excess of forty hours per week but were not paid at the required time and a half overtime rate for this work.
