Carlin et al. v. DairyAmerica Inc. et al., Case No. 1:09-cv-00430, Eastern District of California

This class action alleges that DairyAmerica, the largest marketer of nonfat dry milk, and California Dairies, a processing cooperative, conspired to misreport critical data used by the federal government to calculate raw milk prices paid to dairy farmers.  The lawsuit alleges that as a consequence of this misreporting, tens of thousands of dairy farmers in the United States received less money than they should have for the sale of raw milk during the period January 2002 through April 2007.  The case alleges negligent misrepresentation, fraudulent misrepresentation and violations of the RICO statute, and it seeks to recover financial damages for dairy farmers whose raw milk was priced according to federal government formulas.
